Construction Contractor Pre-Qualification Introduction
Brookhaven Science Associates, L.L.C ("BSA") has entered into Prime Contract DE-AC02-98CH10886 with the United States of America ("the Government"), as represented by the United States Department of Energy ("DOE"), to operate the Brookhaven National Laboratory (BNL). In furtherance of the Prime Contract, BSA desires your firm to provide a qualification proposal for Construction services for work to be performed at BNL.
You are hereby invited to prepare and submit a qualification proposal in accordance with the provisions of this document. For your information and use in preparing this proposal, we are providing you with the following special requirements. Contractors must submit the following documents for consideration:
A) Construction Contractor Pre-Qualification Questionnaire -Attachment I

1. Notice of Total Small Business Set-Aside
Only small businesses will be awarded Basic Ordering Agreement (BOA) contracts.
(a.) Definition. (1) "Small business concern" as used in this clause means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Laboratory contracts and qualified as a small business under the NAICS size standards. See Paragraph 2 below, for information on NAICS codes.
(b.) General. Qualifications are solicited from Small (SB), Small Disadvantaged (SDB), Small Woman-Owned (WOB), Small Veteran-Owned (VOB), Small Service-Disabled Veteran-Owned (SDVOB), and Small HUBZone (HUB) business concerns. Qualifications received from concerns that are not one of these categories, shall be considered non-responsive and will be rejected.

3. Type of Contract – Basic Ordering Agreement (BOA) Contracts
Qualified Contractors will be required to execute a contract containing substantially the same provisions as those contained in BSA General Terms and Conditions for Construction and Labor Hour Contracts and BSA Modernization Project Office (MPO) Bidding and Contract Requirements: Section 07000 – General Conditions and Section 00800 Supplementary Conditions.
For an individual construction project, each Contractor with whom BSA has a BOA for that specific type of work will be asked to submit a lump sum bid based on construction specifications and drawings. BSA will then award a Task Agreement to the low bidder under their BOA. However, if a given Contractor's performance on a previous Task or Tasks has been unsatisfactory, the Laboratory may decline to solicit future bids from that Contractor. Thus, succeeding Task awards will be dependent on price and the Contractor's past workmanship, schedule performance, and safety compliance. Any violation to contractual, construction or ES&H requirements may result in suspension of bidding on any or all subsequent construction tasks. The ceiling amount for any individual task shall not exceed $1,000,000.00.
The minimum wages paid to the tradesmen engaged in construction work for BSA shall be governed by the Davis Bacon Act in accordance with the General Wage Decision minimum wage determination.
5. Insurance Requirements
Certificates of Insurance of the types and in the amounts set forth in the Article entitled "Insurance" in the Terms and Conditions will be required of the Contractor before physical work at the site commences.
6. Bid Bonds
Bid Bonds in the amount of 20% of any bid will be required in all cases where the bid for any given individual construction project exceeds $30,000.00. Any Bond provided must be from a Treasury Listed Surety.
7. Performance and Payment Bonds
In accordance with the Terms and Conditions Article entitled: "Performance and Payment Bond Requirements", Payment Bonds will be required on all Task Agreements awarded under a BOA if the awarded Task Agreement is in the amount of $30,000.00 or more. Performance Bonds will additionally be required for awards $150,000.00 or more. The cost of such bonds shall be borne by the Contractor and shall be deemed to have been included in the bid price. Any bond provided must be from a Treasury Listed Surety.
8. Environment Safety and Health (ES & H) Program and Health and Safety Plan (HASP)
Contractors shall submit and obtain the Laboratory's acceptance of their written Health and Safety Plan. This requirement is in accordance with the Article in the Terms and Conditions entitled:"Compliance with Environment, Safety, Health, and Traffic Regulations".
Once a Contractor's HASP is approved by the
Laboratory, the Contractor shall submit a Phase Hazard Analysis for every Task Agreement awarded before work can begin on site.
